Terms and Conditions

1. Definitions and terms

1.1 The use of terms used in these Terms and Conditions in singular or plural shall not distort the meaning of their definitions below.

1.2 Terms and Conditions - these Terms of Use.

1.3 Shopogolic refers to Shopogolic LTD, a legal entity established under the laws of the United Kingdom and acting in accordance with the laws of the United Kingdom, providing services to individuals or businesses and act us a broker for international delivery of goods.

1.4 Website refers to websites that are identical in content, hosted on the Internet under the domain names shopogolic.net.

1.5 Service refers to the collective set of services, products, and software offered by Shopogolic on the Website.

1.6. User refers to a natural person who utilises the Service.

1.7 Personal Account refers to the section of the Website accessible to the authorised User, containing information about the User and facilitating the use of Shopogolic services.

1.8 Recipient refers to the natural person designated by the User as the recipient of the goods, as well as their duly authorised representatives.

1.9 Inbound Order refers to the postal/courier shipment ordered by the User and delivered in their name to the Shopogolic warehouse from the seller.

1.10 Purchase order refers to the acquisition of goods by the Shopogolic warehouse on behalf of the User, based on their request.

1.11 Outgoing Parcel/Parcel refers to the postal/courier shipment compiled by Shopogolic from an Inbound Order or Inboubd Orders or Purchase orders for dispatch to the User/Recipient.

1.12 Shipment - the sending of Parcels to any country from the list of countries indicated on the Website. Shopogolic does not carry out Forwarding to countries that are subject to sanctions or restrictions affecting the possibility of Forwarding to such countries. Shopogolic LTD may refuse Forwarding at its discretion, without the need to justify such refusal, if it anticipates that the aforementioned sanctions or restrictions may be imposed against the destination country. Shopogolic does not ship Parcels within the country of receipt of the Incoming Order or Purchase Order.

2. General terms and conditions of the Service

2.1 These Terms and Conditions govern the procedure and terms of use of the Service.

2.2 In the event of payment by the User, the party responsible for execution under this agreement is the legal entity Shopogolic Ltd - Unit 2, Bermuda Road, Ipswich, IP3 9RU, United Kingdom.

2.3 Shopogolic.net acts as an agent between the User and the warehouse, utilising partner warehouses for deliveries and processes as required.

2.4 By accepting the Terms and Conditions, the User acknowledges that he/she is using his/her true and complete personal data, has reached the age of majority legally required for the use of the Service, is not a legally restricted person, which would prevent the use of the Service, and is legally responsible for his/her actions, and has read and agrees to follow the list of goods prohibited for shipment.

2.5 The User is obligated to thoroughly review these Terms and Conditions before starting to use the Service. By initiating the use of any service provided by the Service, the User thereby accepts the Terms, constituting acceptance of this offer. If the User disagrees with the Terms in whole or in part, they may not use the Service.

2.6 The Terms and Conditions constitute an offer, consist both of the text of the Terms and Conditions itself and of the other components, provisions and regulations to which the Terms and Conditions refer, including deeper level references therein, and may only be accepted by the User in their entirety, without any modification, with all rules and policies (including Shopogolic's Personal Data Privacy Policy) and procedures and scenarios for the use of the Service, which are published by Shopogolic on the Website, except as expressly stated.

2.7 Shopogolic reserves the right to update these Terms and Conditions at any time. The fact that the User continues to use the Service indicates their acceptance of the revised terms, even if they have not reviewed them. The most recent version of the Terms and Conditions is always available on this page.

2.8 Shopogolic reserves the right to refuse to provide the Service to the User in whole or in part without giving reasons.

2.9 In case of partial refusal to provide the Service to the User, the refund of the money paid by the User for such part of the Service shall be made in accordance with the procedure provided for in the Terms regarding the refund of money and, in particular, section 8 of these Terms.

2.10 In the event of a complete rejection of the Service by the User, the received Inbound Orders of the User - provided that they have provided a prepaid shipping label - will be sent back to the merchants. Otherwise, Shopogolic reserves the right to dispose of the contents of such Inbound Orders/Purchase Orders or to dispose of them at its discretion without any reimbursement to the User. The User's Personal Account shall be blocked and the funds from the balance in the Personal Account shall be refunded to the User in accordance with the procedure set out in the Terms and Conditions regarding refunds and, in particular, in Section 8 of these Terms and Conditions.

2.11 The User is obliged to ensure the security of their login and password for accessing the Service. Shopogolic shall be entitled to assume that all actions in the Service performed by the User authorised with the login and password are performed by the User personally.

2.12 It is not allowed to use as an avatar (the image in the User's account to personalise it) photos or other graphic images of an erotic, obscene, offensive nature, materials prohibited by applicable law, as well as violating legislation in the field of intellectual property protection and image rights. In case of violation of this rule, Shopogolic reserves the right to remove such image and/or apply other measures provided for in the Terms and Conditions. In the event that an image is posted in violation of these Terms and Conditions and the requirements of applicable law, the User shall be liable in accordance with applicable law and these Terms and Conditions, in particular clauses 2.13 and 2.14 of the Terms and Conditions.

2.13 The User undertakes to refrain from breaking the rules of applicable law when using the Service. In the event that the User is found to have committed an offence, Shopogolic shall have the unconditional right to refuse to provide the Service to the User and to recover direct and indirect damages caused to Shopogolic by such use out of court, including by debiting the funds credited to the User's Personal Account. In the event of such misuses, Shopogolic shall be entitled to withhold the User's Inbound Orders until the situation is resolved or use them to reimburse the losses incurred due to the User's unfair actions.

2.14 Under no circumstances may the User/visitor of the Website use any of Shopogolic's intellectual property, including the trademark "Shopogolic", or act as an agent or intermediary of Shopogolic, without prior consent in writing and signed by duly authorised representatives of the User/visitor and Shopogolic. In the event of infringement of Shopogolic's intellectual property rights or dissemination of information that is untrue, the User/visitor shall be liable in accordance with applicable law. Shopogolic also reserves the right to claim damages in such cases, as well as compensation in a fixed amount in addition to the aforementioned damages.

The User shall be solely liable to any third parties for infringement of copyright and image rights belonging to such third parties committed by the User when using the Service, and undertakes to take all necessary steps to prevent Shopogolic from being held liable in such situations. In the event that Shopogolic is held liable for such actions of the User, the latter undertakes to indemnify Shopogolic for all losses and expenses incurred by reason of Shopogolic being held liable in such a situation.

2.15 Situations that go beyond the standard situations are dealt with by Shopogolic with the Users on an individual basis.

3. Description of the Service and its components

3.1 Shopogolic provides the User with the Service, the components of which are the following services:

3.1.1 Providing a virtual address in the UK, Germany, France, Italy, Poland, Spain, USA, Israel, Kazakhstan, Turkey or other countries to receive Inbound Orders and Purchase Orders.

3.1.2 Forwarding. Forwarding includes the following elements:

3.1.2.1 Processing Inbound Orders and Purchase Orders prior to dispatch.

3.1.2.2 Receiving Inbound Orders and Purchase Orders.

3.1.2.3 Combination (consolidation) of Inbound Orders and Purchase Orders.

3.1.2.3 Storage of Inbound Orders and Purchase Orders.

3.1.2.4 Packaging of Inbound Orders and Purchase Orders into a Parcel. Packaging shall be carried out in such a way as to maximise the safety of the contents of the Parcel under the conditions usual for the type of transport used. The weight of the Parcel may change during the packing operations.

3.1.3 The sending of Parcels to the country of the Recipient is at the User's choice, Shopogolic reserves the right to change the method of delivery if the chosen method of dispatch by the User cannot be carried out for one reason or other.

3.1.4 Organisation of delivery within the territory of the Recipient's country using postal and courier services located in this country.

3.1.5 Accompanying the Delivery by informing the Recipient about the progress of delivery.

3.1.6 Purchase order - arranging the purchase of the goods specified by the User in the online shop of the seller trading and delivering on the territory of Great Britain, Germany, France, Italy, Poland, Spain, USA, Israel, Kazakhstan, Turkey or other countries (more detailed conditions of providing the service Purchase order are also contained in section 7 of these Terms and Conditions).

3.1.7 Parcel Insurance - insurance of property interests related to possession, use, disposal of the goods sent in the Parcel due to their damage, destruction or loss, as well as property interests related to incurring expenses for delivery of the goods.

3.1.8 User Support - providing advisory support to Users via Shopogolic's contact form available on the Website. Shopogolic informs the User that all enquiries regarding Inbound Orders and Parcels will be processed by the User Support only if the relevant Inbound Order tracking number, the User's account number on the Site and the id of the Inbound Order/Purchase order are provided. The Support Service responds to User requests in order of precedence from Monday to Friday during working hours from 09:00 to 18:00 in the time zones UTC+5, UTC +2. Support does not operate on public holidays.

3.2 The current prices for the services included in the Service are contained on the Rates page of the Website. Shopogolic reserves the right to change the existing prices without prior notice. Price changes shall become effective from the moment the changes are made on the Rates page.

3.3. The cost of Shopogolic services, as well as the estimated delivery times for Parcels calculated via the Calculator on the Website, are approximate, for reference only, and do not constitute an offer.

3.4. Shopogolic reserves the right to charge the User for the cost of any additional work with an Inbound Order/Purchase Order not covered in the Rates page, as determined by Shopogolic based on the circumstances of the work. This cost will be included in the invoice presented to the User.

3.5 Shopogolic does not provide services for the dispatch of Parcels within the territory of the warehouse country. The only exception is Inbound Orders/Purchase Orders returned to sellers.

3.6 Shopogolic does not provide a service for the pick-up of goods from the seller and does not offer the possibility of picking up the goods from Shopogolic's warehouse. Shopogolic only collects parcels from specific pick-up points. The User must contact support and inquire about the possibility of pick-up and the cost of the service before sending the Inbound Order to the pick-up point.

3.7 Shopogolic reserves the right to update, modify, amend, improve, supplement, reduce, transform and otherwise improve its Services at any time and to any extent. An up-to-date description of the Services and their terms of use is available on the Website.

4. Basic Terms of Use of the Service

4.1. Inbound Orders must comply with the permissible dimensions and/or weight for dispatch. Shopogolic reserves the right to impose an additional charge for oversized parcels that exceed the dispatch parameters upon external examination or measurement. The extra cost for dispatching such parcels is calculated on an individual basis. The User's interaction with shops and postal services, which are responsible for the delivery of the Inbound Order to the Shopogolic warehouse, is carried out exclusively by the User unless the Purchase Order service has been opted for.

4.2. Shopogolic does not guarantee the acceptance and processing of letters (Inbound Orders consisting of postal envelopes) and bears no responsibility for the preservation of such letters. Shopogolic does not accept bank cards, cryptocurrency wallets, or any registered and/or unregistered letters from the User. The User is informed and agrees that such types of Inbound Orders may be disposed of without notifying the User.

4.3. The User is fully responsible for monitoring and verifying the contents of Inbound Orders upon receipt at the Shopogolic warehouse by comparing tracking numbers and store dispatch confirmations, as well as through placing special requests for comparison with the invoice and/or photographing the contents.

4.4. The User grants Shopogolic the right to open their Purchase Orders for verification against invoices, as well as to open Inbound Orders and handle their contents when processing special requests for comparison with the invoice and/or photographing the contents. Shopogolic has the full right to open Inbound Orders upon detecting prohibited items for dispatch in the declaration or if there is suspicion of the presence of prohibited items for dispatch.

4.5. Shopogolic bears no responsibility for goods in Inbound Orders that initially have a manufacturer's defect, or for second-hand goods that have damages due to their use by previous owners. The User is fully responsible for checking the condition of goods before dispatching them from the Shopogolic warehouse by making special requests for photographing/checking the goods. In the event of identifying a manufacturer's defect and/or signs of the product's use, this issue is resolved directly between the User and the seller/store without Shopogolic's involvement.

4.6 Shopogolic shall prepare the Inbound Order for dispatch, as a rule, within 1-2 working days from the date of receipt of the formal request from the User, provided that the Inbound Order does not include any additional services related to additional packaging or method of dispatch and there are no other circumstances affecting this period.

4.7 Once the Parcel has been dispatched, it cannot be cancelled and such dispatch shall be paid for in full by the User.

4.8 Shopogolic does not send Parcels to PO boxes, addresses of other forwarding companies, storage boxes or lockers. The User must ensure that the address is correct, a Parcel not delivered to its destination and/or returned to the warehouse as a result of an incorrect address, inability to contact the Recipient, shall not be considered lost and no refunds shall be made for failed delivery.

4.9 Shopogolic reserves the right to request additional documents confirming the User's identity and the legitimacy of the purchases made and the use of the credit card. This measure is applied selectively and may in particular be aimed at preventing credit card fraud. Document verification can take 5 to 10 working days.

4.10 The User undertakes to provide true and genuine data about the goods sent in the Parcel in the customs declaration. Shopogolic does not guarantee the delivery of the Parcels if the customs declarations related to these Parcels have not been properly completed in accordance with the import and export regulations of the customs services of Shopogolic's warehouse country and the receiving country. It is the User's responsibility to clarify and follow these regulations when sending Parcels.

4.11 The User bears the full and sole burden of any customs payments and any fees related to postal services/couriers and to the crossing of national borders, as well as assumes all possible risks of negative consequences caused by misrepresentation of the Parcel and/or its contents, as well as risks of negative consequences caused by sending prohibited and/or dangerous goods.

4.12 If the User has been notified of the need to pay any customs fees or re-export fees for the Parcel in accordance with the requirements of applicable law, but refuses to pay such fees, such User shall be deemed to have given up the rights to the Parcel in favour of Shopogolic. Shopogolic shall be entitled to dispose of the Parcel at its sole discretion and to retain those Parcels that are in storage or in transit and have not yet been delivered to the User within the scope of the use of Shopogolic's services. In the event that the User in such a situation pays the above-mentioned costs to Shopogolic, in particular in connection with the payment of customs duties and re-export of the Parcel, when such Parcels or the Parcel has not yet been disposed of or sold, Shopogolic shall return the rights to the Parcels/Parcel to the User and shall place the Parcels/Parcel at the disposal of the User. All delivery costs of the Parcels/Parcel shall be at the User's expense. In any case, Shopogolic reserves the right to claim compensation for all costs and possible losses caused by the User's refusal to pay the aforementioned customs fees.

4.13 Shopogolic reserves the right to refuse to provide services to the User if the User uses foul language and abusive language against Shopogolic and Shopogolic's employees.

4.14 Shopogolic shall provide any services on a first-come, first-served basis within 1-2 working days of the User's registration of the service (this does not include the day of registration of the service by the User, public holidays and weekends).

4.15 The User undertakes to check the availability of the Virtual Address in personal account before making a purchase of an Incoming Order. If the Virtual Address is not available and the User's Incoming Order is in transit, Shopogolic reserves the full right to refuse to search for the Incoming Order.

5. Procedure for providing Purchase Order service

5.1 When placing a Purchase Order in the personal account, the User is obliged to indicate the full value of the goods, the cost of delivery of the goods to the Shopogolic warehouse in the country of the order, as well as the taxes applicable in that country. In the event that the User has not indicated the necessary data or has indicated them incorrectly, Shopogolic shall be entitled to withdraw from the User's account the amount necessary to cover the costs incurred in the purchase of the goods specified by the User up to a maximum of 20% of the value of the goods, notifying the User by issuing an additional invoice. Specifying the sizes (for clothes, shoes, etc.) it is necessary to indicate the local sizes of the country of the warehouse where the Purchase Order service was requested.

5.2 The User is responsible for the conformity of the purchased goods with the delivery conditions of the postal service and the customs code of the country in which the order is purchased.

5.3 In case of participation in the auction through the personal account, the User must deposit the necessary amount to the personal account in advance. In case of shortage of funds on the User's personal account, further increase of bids is impossible. Buying on Ebay auction is possible only from sellers with a rating of 5 or higher, and the goods must be won directly by the company. We do not redeem or pay for items won by third parties on their accounts.

5.4 Shopogolic shall provide the Purchase service on a first-come, first-served basis within 1-2 working days from the moment the service is performed by the User (this does not include the day on which the service is performed by the User, public holidays and weekends). Shopogolic undertakes to pay the goods specified by the User to the seller, on behalf of the company, provided that this seller delivers the goods within the territory of the country of transaction. Shopogolic is not responsible for the delivery time of the goods from the Seller to Shopogolic, as it is not the party providing the service of delivery of goods to the warehouse.

5.5 If the ordered Goods are not available in the Seller's stock, Shopogolic has the right to cancel the ordered Goods from the User's Purchase without notice or to notify the User by sending an email to the email address specified during the registration of the personal account.

5.6 Shopogolic is not responsible for the dishonesty of the sellers selected by the User in the following cases: the goods are sent with a delay; the goods are sent but do not correspond to the description; the goods do not work (although they are described as working); the goods are not sent (cases of fraud).

5.7 Shopogolic is obliged to accept in its warehouse the goods that have been delivered by the postal service/courier service from the seller. In the event that the seller has not dispatched the goods, Shopogolic shall endeavour to do its best to refund the money paid, but does not guarantee its return, and in this case will not compensate the User's losses. The Seller is chosen by the customer and Shopogolic is not responsible for the actions of the Seller.

5.8 Shopogolic is not responsible for the timing of replies from sellers and reserves the right not to contact the seller 14 days after the purchase of the product.

5.9 Shopogolic can perform an external product inspection for defects based on actual product photos from the seller. If any defects are found, Shopogolic undertakes to notify the User by sending an email or comment on the Purchase Order and to take all necessary actions to return the defective goods and refund their value.

5.10 In case of cancellation at the request of the User of the paid goods, the User will be charged the cost of return deliver to the Seller, the commission fee is not refunded. Cancellation of purchase from Ebay auction is impossible, if the seller in the description of the lot does not specify the rules of return of goods, if the rules of return of goods are specified, then the return is possible according to these rules.

5.11 Shopogolic is obliged to pack the User's goods received at the warehouse according to the data specified by the Customer in the "Parcels" section of the personal account. In the event that the Customer's parcel cannot be sent by the delivery method specified by the User due to weight or dimensions, Shopogolic has the right to change the method of delivery of the parcel without notifying the User.

5.12 Shopogolic has the right to refuse the User the purchase of any product without giving any reason.

5.13. Shopogolic takes photos of the Purchase Order for internal use, in this case the photo is not obligatory. If additional photos are required, the user must pay for this service separately according to the warehouse rate.

6. Procedure for providing Virtual Address service

6.1 In order to use the Virtual Address service, the User needs to confirm the identity and legality of the purchase. Delivery of parcels when using the Virtual Address service by the User is possible only to the recipients whose name is the same as the name of the owner of the bank card or PayPal, from which the payment for the goods delivered in the parcel was made.

6.2 The virtual address may not be used for the opening of companies or any other legal or official public services. Shopogolic is obliged to contact the company formation organisation in the country of presence to cancel any activity of any new company at Shopogolic addresses. The use of Shopogolic addresses in any of the countries as a paying address, for the opening of companies, for use for any purpose other than private purchases is strictly prohibited and all funds accepted for the provision of services in case of infringement will not be reimbursed.

6.3 The "Virtual Address" service in any of Shopogolic's countries may not be used to receive goods paid for illegally using third party funds without their consent, gift cards or certificates, goods purchased on credit or in names other than the account holder. All goods must be personally paid for by the User in Personal Account using the User's personal funds. It is forbidden to specify the virtual address of the company as the Billing Address in any shops. It is prohibited to buy goods with customs duties or prohibited by the legislation of Shopogolic or User's country.

6.4 The Virtual Address service is provided exclusively for shopping in shops and auctions that accept cards or payment systems valid in the User's country. Shopogolic does not accept inbound orders from individuals as gifts without proof of official payment in the form of invoices on behalf of the User.

6.5 Shopogolic reserves the right to request and verify documents, bank or account statements, passport data, cards of the User to verify payments or to refuse to fulfil the service without prior notice to the User. All fraud data may be forwarded to cybercrime authorities, the police of the country where the service is provided, the User's country of residence and customs authorities.

6.6 All Inbound orders for the Virtual Address service are added to the User's personal account on a first-come, first-served basis within 1-2 working days from the moment the service is ordered by the User (these terms do not include the day of ordering the service by the User, holidays and weekends). The period of adding Inbound order by the warehouse may be extended.

7. Parcel Creation and Delivery

7.1 Delivery of Inbound Order/Purchase Order shall be made by the methods and at the rates set out in the Delivery and Rates pages of the Website.

7.2 The final cost of delivery of the goods to the Recipient is determined after the parcel has been packed and weighed. In case of insufficient funds in the Customer's account, the transfer of the parcel to the delivery service will be suspended until the User settles the debt in his/her personal account.

7.3 The Shopogolic delivery costs and the estimated delivery times of the Parcels generated by the Calculator on the Website are approximate, are for reference only and do not constitute an offer/not guaranteed by Shopogolic.

7.4 Shopogolic is obliged to deliver the Outgoing Parcel containing the User's goods to the postal service/courier service that the Customer has specified in the "Parcels" section of the personal account. The Services shall be deemed to have been fully rendered by Shopogolic from the moment the User's Outgoing Parcel is handed over to the postal/courier service.

7.5 Parcels may not be sent to other addresses of forwarding companies, intermediaries, legal addresses, drop-off points, post offices, lockers or agents to avoid fraud.

7.6 Shopogolic does not deliver to the following countries: Nigeria, Cuba, Iran, Iraq, Syria, Palestine, North Korea and countries where delivery has been cancelled due to political circumstances. Shopogolic undertakes to notify the User of the cancellation of the delivery of the parcel by providing the corresponding status.

8. Terms of return and exchange

8.1 In case of return/exchange, the cost of shipping the goods from the User back to Shopogolic's warehouse and from the User back to the Seller, as well as in the opposite directions, shall be paid by the User.

8.2 Shopogolic decides whether the goods can be returned/exchanged based entirely on the Seller's decision on the possibility of return/exchange. If a defect, discrepancy or shortage of goods is detected without the User having previously ordered an inspection service for the goods in question, the return/exchange of the goods is only possible subject to an additional service fee.

8.3 If the Seller decides to refuse the User a return/exchange, Shopogolic will not compensate the User for the value of the Goods and the decision on whether the Goods can be returned to the User again will be made by Shopogolic on a case-by-case basis.

8.4 All return/exchange operations are carried out in full compliance with the Seller's terms and conditions, including but not limited to the terms, procedure and amount of compensation. Refunds to the User shall be made after the Seller has fully refunded the value of the goods to Shopogolic.

8.5 If the exchanged goods are re-sent, the User will pay Shopogolic's full order processing fee in accordance with the rates.

8.6 In case the User decides to refuse partially or completely the Incoming Order, the User must return the goods to the shop where they were purchased, in accordance with the terms and conditions of that shop. The User must provide a pre-paid return label and pay the cost of the return service at the rate indicated on the Shopogolic website. In the case of the absence of a prepaid label, the User may use Shopogolic's services to create a return parcel to the shop's address. In this case, the return address must be exactly the same as the address of the original sender of the order. If Shopogolic employees detect an incorrect address (addresses of competitor companies, personal address, locker address, point address, etc.), Shopogolic reserves the full and absolute right to refuse to provide the return service to the Customer. Shopogolic undertakes to send the order for return once the User has paid the invoice in full.

8.7 In case the User decides to refuse partially or completely from a Purchased Order (OR) in the status Fulfilled/Received, the User is obliged to leave a request for the return of goods to the shop via the Shopogolic contact form or chat support. In this case, the User will receive a partial refund to the balance in the personal account without refunding the commission for the performance of the Purchase service.

9. Terms and conditions of storage of Inbound Orders, Outgoing Parcels and Purcahsed Orders

9.1 Shopogolic agrees to store Inbound Order without charge for a period of 60 (sixty) calendar days from the date of receipt by Shopogolic. After the expiration of this period, Shopogolic reserves the right to charge the User a storage fee in the amount specified in the Fees section. Such fee, as well as other fees specified in dollars, euros or pounds under these Terms and Conditions, may be converted into the currency of the country in whose territory the respective settlement is to be made, at the exchange rate of the central state bank of such country on the date of settlement. The total storage period of the Inbound Order/Purchase Order may not exceed 6 (six) months. If the Inbound Parcel/Purchase has not been claimed by the User after the expiry of this period or if there is an overdue debt not paid by the User within the time period specified by Shopogolic for payment, Shopogolic reserves the right to dispose of the contents of the Inbound Order/Purchase Order or to dispose of them at its discretion without any compensation to the User.

9.2 Shopogolic is not responsible for identifying the owners of Inbound Parcels on which the delivery address and the recipient are incorrectly (incompletely) indicated. Shopogolic reserves the right to charge a storage fee for each such Inbound Parcel according to the standard fee in clause 5.1 of these Terms and Conditions. If, after 6 (six) months from the date of delivery of the Inbound Order to the warehouse, the User has not contacted Shopogolic and confirmed the ownership of the Order, Shopogolic reserves the right to dispose of the contents of the Inbound Order or to dispose of them at its own initiative without any compensation to the User.

9.3 Shopogolic agrees to store the Parcel packed and ready for shipping for a period of 60 calendar days in the country of storage without any additional charge. If the Parcel has not been claimed by the User after this time, Shopogolic reserves the right to dispose of the contents of the Parcel or to dispose of them at its own initiative without any compensation or notification to the User.

9.4 The User will be charged for the storage of unidentified incoming orders (Lost property) if, on delivery, the Shopogolic User id was missing on the sender's label, if the recipient's name does not match the User's name and User id, if the User's name and User id are partially or completely missing on the parcel. In these cases, storage is counted from the moment the parcel is received at the Shopogolic warehouse.

9.5 The free storage period of the packed but unpaid parcel by the User is 10 calendar days. After 10 calendar days, the customer will be charged the cost of storing the parcel at the price specified on the Rates page.

10. Responsibility for the security of the Parcels

10.1 Shopogolic acts, by virtue of applicable law, as an agent organizing the Forwarding for the User and does not independently deliver the Parcels to the User.

10.2 Shopogolic is not liable for the actions of any third parties or delivery organizations, in particular postal and courier services, all conditions and limits of such possible liability of third parties are subject to their individual agreements and regulations.

10.3 In certain cases, Shopogolic may, at its discretion, assist the User with the matters set out in the preceding paragraph, for which purpose the User, by accepting these Terms and Conditions, authorises Shopogolic with appropriate powers to conduct on behalf of the User the necessary negotiations, approvals, correspondence and to obtain, with a view to subsequently transferring to the User, financial compensation for lost or damaged Parcels and their contents, and Shopogolic assumes such powers in order to resolve the matter as fully and as quickly as possible. Such assistance on the part of Shopogolic is not a service provided on a reimbursable basis and does not impose any obligation on Shopogolic, including any obligation to guarantee indemnity to the User.

10.4. To resolve issues related to civil liability for the safety of Parcels and their contents (except in cases of Parcel loss) with postal and courier services, the User is required to provide a video recording of the Parcel unpacking process in a manner agreed with Shopogolic. This video recording must capture the unpacking procedure from the very beginning - with the Parcel's sealed packaging filmed from all sides, and through to the end of the process - until the full visual representation of the goods contained in the Parcel. Throughout the entire video recording, the Parcel's box must be fully visible in the frame, not just a part of it, and the recording must preclude any interaction with the Parcel and/or the goods contained within it and/or their packaging off-camera.

10.5 Shopogolic will accept the User's claims regarding Parcels within a maximum of 7 (seven) days from the date of delivery of the Parcel to the Recipient.

10.6 To ensure possible compensation for losses caused by loss or damage of parcels, the User is highly recommended to use the parcel insurance service (The maximum amount of insurance coverage is 990 c.u.). To apply for the insurance claim, the User is obliged to provide a damage or loss report drawn up by the post office or courier, as well as photographs of the packaging when opened and photographs of the contents. The parcel must be opened in the presence of the courier or at the courier or post office to officially confirm the fact of damage or partial loss of the goods. Losses under the insured event shall not be considered without the act. The insurance covers the declared value of the goods in the Parcel. The period of consideration of the insured event may be from 1 to 3 months.

10.7 In the case that the User has paid the cost of insurance for goods specified in the list of non-insurable goods on Shopogolic's website, Shopogolic is obliged to refund the User the cost of insurance fee to the balance in the personal account.

10.8 Shopogolic does not make any compensation for moral damages, indirect and consequential damages, as well as compensation for losses related to Users' own business in any way. The Service is designed to provide services to individuals who purchase goods solely for personal, family, household and other needs not related to business activities.

10.9 Any liability of Shopogolic cannot exceed the value of the services rendered to the User under a particular order.

11. Payment and Refunds

11.1 Payment for Shopogolic's services shall be made by invoicing the customer and shall be made by the methods and at the rates set out in the Delivery and Rates pages of the website.

11.2 Shopogolic does not credit Users, does not purchase goods on credit and does not send Parcels on credit. All services must be paid in full before the parcel is dispatched as invoiced.

11.3 Shopogolic will refund the User in the cases provided for in the Terms and Conditions.

11.4 Return of funds to the User, unless otherwise agreed, is carried out by returning funds to the User's balance in Personal Account. Return of the balance of funds is possible at the initiative of the User by withdrawing funds from the User's Personal Account. Withdrawal of funds is carried out only to the User's initial payment methods. In cases where the User's Personal Account is subject to cancellation, as well as in other cases expressly agreed between Shopogolic and the User, the refund shall be made by the methods available to Shopogolic at the time of withdrawal of the above mentioned funds.

11.5 If Shopogolic decides to refund the User, such refund shall be made by Shopogolic within 5-10 working days. Shopogolic may inform the User of the planned refund period. The period of time for the User to actually receive the refund may be longer depending on the speed of banking procedures, which is not the responsibility of Shopogolic.

11.6 Shopogolic is not responsible for any bank charges that the User may incur in the refund process.

12. Force majeure circumstances

12.1 Neither Shopogolic nor the User shall be liable for failure to fulfil or improper fulfilment of an obligation arising from the Terms and Conditions if such failure or improper fulfilment is due to force majeure, i.e. extraordinary and unavoidable circumstances. Force majeure circumstances (force majeure) shall mean: wars, declaration of a state of emergency or martial law, floods, fires, earthquakes and other natural disasters, strikes, changes in applicable laws, imposition of sanctions or embargoes, as well as any other circumstances that the affected party cannot realistically influence and that it could not reasonably foresee, with the said circumstances preventing the fulfilment of obligations under this Agreement, and their occurrence is not a direct or indirect result of an act or omission of one of the Parties.

13. Limitation of liability

13.1 Shopogolic is not liable for any costs incurred by the User or direct/indirect damage that may be incurred by the User due to the use of Shopogolic's services, caused to the User as a result of the use or inability to use the Services and incurred as a result of errors, omissions, interruptions, deletion of files, changes in functions, defects, delays in data transmission, etc.

13.2 Shopogolic is not responsible for the actions of related services and services, courier companies, post offices, customs authorities used to provide the Services to the User but not owned by Shopogolic, such as banks, postal services, providers, Email services, payment systems, etc.

13.3 The User agrees not to make Shopogolic a defendant or co-defendant for any liabilities and costs related to damages caused to the User as a result of the actions of third parties, including Sellers, Postal and courier services, payment systems.

13.4. In the event of an invoice being filled out by the User or by authorised representatives of Shopogolic on behalf of the User, as arranged in the personal account, the User bears responsibility for the accuracy and completeness of the information provided in the declaration and invoice.

13.5 Shopogolic shall not be responsible for the imposition of Customs duties on the delivery of the parcel, shall not compensate for them, and shall not represent the interests of the User before the customs authorities.

13.6 Shopogolic is not an employee of the transport company or postal service and is not responsible for any of the ways in which the goods are sent.

13.7 Shopogolic shall compensate the User's losses upon application and only if the claimed losses were caused by errors made by Shopogolic's employees. The amount of the indemnity may not exceed the contractor's commission.

14. Dispute resolution

14.1 In case of any disagreements and disputes related to the fulfilment of the terms of this Agreement, the parties shall resolve them by negotiations.

14.2 When registering and topping up the account, the User undertakes all obligations and agrees with this agreement and the rules of use of the service.
